Items of Urgent Business

3.

Declarations of Interests

Please indicate if there are any interests which should be declared.  A declaration of an interest should indicate the nature of the interest (if not already declared on the Register of Interests) and the agenda item to which it relates.  If a disclosable pecuniary interest is declared, the member should withdraw from the room whilst the matter is discussed.

To consider a review of a Premises Licence

Minutes:

The Chairman welcomed everyone to the meeting and declared that the Sub-Committee was sitting to consider an application for a review of a Premises Licence in respect of King’s Lynn Express, 103b High Street, King’s Lynn.  He introduced the Sub-Committee, the Borough Council officers and the legal Advisor and explained their roles. 

 

Officers from Norfolk Trading Standards (the Applicant) introduced themselves.

 

The Officer from Norfolk Constabulary (Responsible Authority) introduced himself.

 

The Licence Holder was not present at the Hearing.  He had notified the Council that he had wished to have the Hearing rescheduled and the Legal Advisor had contacted the licence holder immediately prior to the Hearing to enquire why he was unable to attend.  No reason was provided other that the Licence Holder was currently not in the local area.  The Chairman decided to proceed with the Hearing in his absence.

 

The Legal Advisor explained that the Licence Holder had indicated on the telephone that he wanted his name removed from the Premises Licence, however, this would have to be done in writing as part of a formal process.

At the request of the Chairman, the Legal Advisor outlined the procedure which would be followed at the Hearing.

Minutes:

The Senior Licensing Officer presented her report.  She explained that Norfolk County Council Trading Standards had made an application to review the premises licence for King’s Lynn Express, 103b High Street, King’s Lynn under the crime and disorder licensing objective. 

 

The Sub-Committee confirmed that they had read the Senior Licensing Officers report which had been included in the agenda.

 

In response to a question from Councillor Miss Sandell it was confirmed that should the Licence Holder wish to remove his name from the Premises Licence this would have to be done in writing and had no impact on the report being considered today.

Applicant's Case

Minutes:

Norfolk Trading Standards, as the applicant of the review application, presented their case.  They outlined the reasons for the review and informed the Sub-Committee that the review application had been supported by Norfolk Constabulary.

 

The Sub-Committee was provided with a timeline of events and evidence.  The representatives from Norfolk Trading Standards responded to questions from the Sib-Committee.

Norfolk Constabulary presented their case and it was explained that they supported the review application.

The Senior Licensing Officer summed up her case.  She provided information on the relevant sections of the Home Office Section 182 Guidance and the Borough Council’s Statement of Licensing Principles.

 

She requested that the Sub-Committee consider her report and the information submitted at the Hearing and dispose of the application using one of the methods as set out in the report.
